In April 2008 the new Corporate
Manslaughter Act came into force. Essentially this new legislation
means that for the first time, companies and organisations could be found
guilty of corporate manslaughter. If a person dies as a result of management
failures that result in a breach of a duty of care, this is known as corporate
manslaughter.
Besides
the financial burden of unlimited fines, which on conviction
would not be covered by insurance, the consequences of being
found guilty of corporate manslaughter could involve your company or organisation
being forced to advertise the fact that it had been convicted of the offence.
This potential PR disaster which would include publicising details of the
conviction and fines received, could prove to be extremely damaging for
any company whatever the size.
With expert knowledge and experience, McCormack Benson Health and Safety
Consultants are perfectly positioned to provide a solution to help protect
your company or organisation against such a tragedy. We will provide you
with the tools needed to help avoid serious accidents happening in the
first place but in the event of a fatality, our documentation and systems
will provide a solid defence should any court action be brought against
you.
